Terms & Conditions

1.  Definitions

1.1 'British Association of Anger Management' (BA-AM) – the body governing the content of Beating Anger -  Anger Management courses, as delivered by the BA-AM Coaches, and responsible for providing accreditation and training to BA-AM Coaches.

1.2 'BA-AM Coach' – The person trained and authorised by BA-AM to offer coaching and to take Events.

1.3 'BA-AM Clinic' – The Local office with which the Client or Participant contracts to take the products or services.

1.4 'Client' – the person being coached by the BA-AM Coach in a 1:1 Session.

1.5 '1:1 Session' – an hourly booked therapeutic session provided by the BA-AM Coach for the benefit of the client.

1.6 'Event' – a single instance of a Beating Anger course, Taster Evening, or similar session.

1.7 'Participant' – An attendee of an Event.

 

2.  Event Details - Dates, Times and Venues – other than 1:1 Sessions

2.1 Details of dates, times and venues are displayed on the website or other promotional material.

2.2 Whilst every care is taken to ensure that venues are reserved and available for the Event, sometimes, for reasons out of our control, it is necessary to substitute one venue for another or to change times or dates. Therefore Event dates, times and locations are subject to change.

2.3 Where Event details are changed, the BA-AM Clinic will make reasonable attempts to contact Participants and inform them of the change; however, we can take no responsibility for loss or damage howsoever caused by a change of Event details.

2.3.1 If, when contacted, Participants are unable to attend at the changed venue or at the changed times, they will be offered a place on the next convenient Event of the same type. In this case no refund is payable.

2.3.2 For the benefit of everyone present, Participants are asked to arrive 15 minutes before an Event.

2.3.3 Where Participants are unavoidably delayed, they are requested to contact the BA-AM Clinic to inform us of the situation and estimate a time of arrival. Where possible an alternative will be arranged.

2.3.4 In severe cases, as deemed by the BA-AM Coach, persistent lateness, or missed appointments may result in exclusion from the remainder of the programme. In this case no refund is payable.

 

3.  Event Details - Dates, Times and Venues –1:1 Sessions

3.1 Counselling can be very demanding, frustrating and emotional and there can be a reluctance to attend. The regular attendance on Sessions with a minimum of absences is paramount to the success of the counselling relationship. Gaps in counselling will slow down the process.

3.2 Dates, times and venues will be agreed between the BA-AM Coach and the Participant, either during the counselling appointment, or by telephone/email with the BA-AM Clinic.

3.3 1:1 Sessions will last for a maximum of one hour and a maximum of one session per week or as mutally agreed between the individual clinic coach and the Participant.

3.4 Clients are asked to arrive 15 minutes before any Session they are required to attend.

3.5 1:1 Sessions with the client will be cancelled if the client is more that 15 minutes late for the agreed appointment. In this case no refund is payable.

 

4.  Drugs and alcohol

4.1 It is an express condition of course attendance that Participants are not under the influence of alcohol, drugs, other than those prescribed by a medical practitioner and agreed by the BA-AM Coach as not to affect attendance on the course.

4.2 For BA1 evening courses, Participants are required to abstain for a period of 24 hours before and after each session.

4.3 For BA2 weekend courses, Participants are required to abstain for 24 hours before the course, the entire weekend of the course (including non-course time) and for 24 hours after the course concludes.

4.4 Participants will be asked to leave if, in the opinion of the BA-AM Coach, they are deemed in breach of this clause, and their further attendance is deemed to be to the detriment of other Participants, or a safety risk. In this case no refund is payable.

 

5.  Violence or abuse

5.1 The safety of Participants and of the BA-AM Coach is paramount. It is an express condition of course attendance that Participants are not violent or abusive at any time during the course. Any violence or abusive behaviour will result in immediate exclusion. In this case no refund is payable.

 

6.  Exclusion of Participants and Clients

6.1 The BA-AM Coach has absolute discretion to exclude a Participant at any time during the Event if the above rules of attendance are broken, or the BA-AM Coach deems there to be a threat to the safety of Participants or BA-AM Coach or to property. In this case no refund is payable

6.2 The BA-AM Coach has absolute discretion to exclude a Participant at any time during the Event if it is deemed that the needs of the other participants will be affected. In this case no refund is payable.

6.3 The BA-AM Coach has absolute discretion to terminate a 1:1 Session at any time, if the BA-AM Coach deems there to be a threat to the safety of the Client or BA-AM Coach or to property. In this case no refund is payable.

 

7.  BA-AM Discretion

7.1 In exceptional circumstances, if sufficient concern exists about risk to the Client or others, the BA-AM Coach may seek help  outside the counselling relationship, but would always seek to gain the Client’s agreement to this.

7.2 The BA-AM Coach reserves the right to cancel counselling and refer the Client to an external agency if it is felt in the best interests of the Client to take this action.

 

8.  Payment of Fees

8.1 Details of fees are published on the website along with the appropriate Event or Session material.

8.2 Taster Evening Events may be paid at the  time of booking or on arrival at the Event.

8.2.1Payment may only be made by cheque or cash.

8.3 Other Events must be paid for in full at the time of booking.

8.3.1 Payment may be made by cheque, debit/credit card or by funds transfer, subject to local BA-AM Clinic facilities.

8.4 At the time of booking an Event or a series of Sessions, the BA-AM Clinic will send an email to confirm the fees payable.

8.5 1:1 Sessions may be paid for as follows:

8.5.1 An initial payment to cover Sessions 1 – 6 and materials before the start of the Sessions

8.5.2 A stage payment to cover Sessions 7 – 10 payable before the start of Session 7.

8.5.3 A final payment to cover Sessions 11 – 14 payable before the start of Session 11.

8.5.4 Any extra Sessions required shall be agreed with the BA-AM Coach and paid for before the start of the Session at the standard Session rate.

 

9.  Cancellation Policy

9.1  All Events, including Taster Evenings:

9.1.1 In the event of cancellation by the Client or Participant, we regret that if the cancellation is made in less than 6 weeks prior to a programme we cannot refund fees taken in advance for Taster Evenings or other Events. In this case the Client may opt to attend an event of a similar type on a later date, or to send a substitute in their place.

9.1.2 In the event of a refund, there will be a £72 administration fee.

9.1.3 In the event of cancellation by BA-AM, the Client will be given the option of taking a refund or joining an event of a similar type at a later date.

9.2 1:1 Sessions:

9.2.1 The Client and the BA-AM Clinic each provide the other with a minimum of 2 working days to cancel a Session.

9.2.2 If the Client does not provide 2 working days notice to BA-AM Clinic, the Client will be charged for the Session.

 

10.  Confidentiality

10.1 All information about the Client will be kept secure.

10.2 The BA-AM Coach will take all reasonable precautions to keep information on a Client safe and secure and will not share the information with any third party, without the express consent of the Client, except:

10.2.1 As with all counsellors, it may be necessary to discuss the content of a Session or Event with the BA-AM Coach’s professional supervisor.

10.3 From time to time, BA-AM may Client contact information for its own marketing purposes. Clients not wishing to be included in such campaigns may contact BA-AM to opt out from this service.

10.4 In the case of a disclosure concerning acts of terrorism under the terrorism act, or acts specific to the children’s act, confidentiality will be broken and such disclosures will be passed onto the relevant authority without delay.

10.5 The BA-AM Coach may make audio or written notes during a Session. These will be kept in accordance with the Data Protection act (1998). These are purely to help the BA-AM Coach in his/her work with the Client. They are disclosed to no one, except to the BA-AM Coach’s professional supervisor, if necessary. These notes will be securely stored for the duration of the Client’s relationship with BA-AM and then for two years afterwards.

 

11.  Ethics and code of conduct

11.1 BA-AM is recognised by the BACP, and accredited BA-AM Coaches work within the ethical framework for good practice in Counselling and Psychotherapy, as laid down by the BACP. A copy of the ethical framework for good practice in Counselling and Psychotherapy can be found on the BACP’s web site.

 

12.Variation of these Terms

12.1 BA-AM reserves the right to amend these Terms and Conditions at any time.
